The single-family home has an existing deck that was constructed prior to the City’s current <br />regulations and does not meet the average lakeshore setback. The applicant is proposing to expand the <br />deck by approximately 205 square feet and the deck will be closer to the lake by seven feet in order to <br />have better use and enjoyment of the deck. The proposed deck meets all other required setbacks <br />including the 75-foot lakeshore setback and complies with hardcover. <br /> <br />Practical Difficulties Analysis <br />Applicant Submittal Information: The applicant has identified the existing conditions of the property as a <br />practical difficulty. The entirety of the existing deck is in front of the average lakeshore setback line, which <br />does not allow for any expansion. The home is situated on the property in such a way that the expansion <br />of said deck would not impact the lake views of the neighboring properties. <br /> <br />Planning Staff Practical Difficulty Analysis: Staff agrees with the applicant’s assessment. The existing deck <br />does not comply with the average lakeshore setback requirement and expansion is not possible without a <br />variance. The deck expansion does not impact the neighboring properties site lines and therefore meets <br />the intent of the ordinance.
