PAGE 3 <br />PAINTERS CREEK <br />LOPMENT Lucy Yogerst of 4740 Bayside Road asked what happened <br />to the last application for this piece of property. <br />Zoning Administrator Mabusth stated that that <br />application was formally withdrawn. <br />Margaret Olson of 4645 Bayside Road (18 acres) stated <br />that she wasn't in favor of the rezoning and feared <br />that it might invade their privacy. <br />Ron Bastyr stated that this development would be <br />unique because of the substantial berming which would <br />keep the privacy. <br />Margaret Olson of 4645 Bayside Road stated that it is <br />not just the privacy but also the possibility of sewer <br />coming down Bayside Road. <br />Chairperson Goetten stated that is why it would be 2 <br />acres which would allow enough room for septic <br />systems. <br />Peter Achey of 4720 Bayside Road (1.06 acres) stated <br />that Orono's own Zoning Code paragraph 34.001, says <br />that "R-IA requires that districts shall have <br />immediate access to highways and public sanitary <br />sewers.” Achey stated that the RR-IA requires a 5 <br />acre minimum lot size to stear away from sewer. Achey <br />stated that is the reason that there still is the 5 acre <br />zone so that sewer won't be required. <br />Zoning Administrator Mabusth stated that there are <br />sections in the Comprehensive Plan where it <br />specifically states that the City is aware that to <br />really sustain a rural lot, 2 acres is completely <br />adequate to satisfy a septic system with an alternate <br />site. Mabusth stated that the 5 acre zone is there <br />because the people in the area wanted it that way and <br />that it really isn't a necessity, but that it was the <br />peoples desire.
