mmES OF A PLANNING OppSSION MEETING HELD iCTOBER 18^76 - PAGE 2 <br />Q^xwoman IXmlap amounced at 7:51 p.m. that this was the <br />time and place for the Public Hearing on the Long Lake Fire <br />Lane Usage located at 1535-1545 Long Lake Boulevaid. The <br />Asst. Zoning Administrator presented the Notice of Public <br />Hearing and the Affadavit of Publication. <br />Mr. Olsm stated that the City had recently been informed <br />that this area was being used for swinming and docking of <br />boats. Notification was given to remove the dock. Neighbors <br />then approached the Council requesting that the City open <br />this area as public access. As a result of this di:»cussiQn <br />at the Council meeting, a Public Hearing was scheduled for <br />this evening. He further stated that the Comnission should <br />have received a copy of a letter to Bruce Malkerson from <br />James Lane idio is the attorney representing Ridiaid <br />Mirlowski. The letter defines the legal status of Ivy Lane. <br />Mr. Lane stated that it is important to distinguish tetween <br />a dedicated street and a mere easement for such street use. <br />The Asst. Zoning Administrator stated that our City Attorney <br />agrees with what is put forth in this letter. Several con <br />cerned neighbors were present at this meeting. The following <br />came forth to identify themselves: Robin Crawford, Donna <br />Crawford, Lew Capron, Dick Murlowski and George Olen. Mr. <br />Crwford stated that Ae neighbors in the immediate area have <br />enjoyed the use of this beach for swimning would like to <br />continue the use as sudi. There is room for only one dock <br />and Mr. Crawlord has been the only one docking a boat. He <br />stated that the City had been taking care of this area when <br />he moved in 5 or 6 years ago. <br />Mr. Murlowski then approached the Commission. He stated that <br />he ^ been living here since August of this year. He is: <br />familiar v;ith vhat has been happening and wants no hostility <br />from this action. After talking with A1 Olson and Attorney <br />lou Cbeihauser, he feels this should be a restricted area <br />and w^d like the privacy. He presented severox pictures <br />of this area to the Commission. <br />^rge Olen informed the ConmLssion that he had been living <br />in this area for 10 years and felt it was a public access. <br />He mentioned that there weren*t any problems until Rev. <br />Westerdahl, the previous owner of Murlowski *s property, com <br />plained. They have been using it mainly for the enjoyment of <br />the children and have been keeping the area clean. Mr. <br />Cra^ord then explained about the day Mr. Westerd^ com <br />plained. It was very hot that day and they had been cleaning <br />^e beach area. They were drinking beer, but were not <br />having a party. Mrs. Crawford mentioned that idien they pur <br />chased their property the real estate agent from Roger <br />Fazendin Realtors told them they would have lake access. <br />Ann ^ron then explained that Jim Albee, the original <br />suibdivider, stated it was a pUblic road and he wanted every <br />one to use it. <br />M Olson stated thct perhaps these residents would be interested <br />juian item coining on the agenda regarding land donated to the <br />Orono Park Department by Bruce Dayton. <br />After all the Public were heard, the Public Hearing was closed ftt 8:2S p.m. <br />LONC LAKE FIRE LAIC USAOB <br />1535-1545 LONG LAKE BLVD. <br />C*183) <br />1
