In MPR Projects <br />containing 50 or more units in all construction phases, 10 percent of the total number of <br />units shall be provided for eligible persons or families in the low and moderate income <br />range. This provision may be waived by the City Council if: <br />(a) The percentage of existing low and moderate income housing in the <br />City exceeds the percentage of such units in the Metropolitan area; <br />(b) funds for subsidy program are not available within one year of appli <br />cation; <br />(c) the City Council determines that the site location is inappropriate for <br />such units because of the lack of public and private support services. <br />a. Density Credit: For all eligible Projects providing housing units for low and <br />moderate income persons and families. Cne additional unit will be permitted for <br />each 10 units allowed under the standard site area requirements of the M-6 District. <br />b.Procedure: In order to provide low and moderate income dwelling unitS/ the ap <br />plicant shall propose application($) to the Federal Housing Administration (FHAl <br />of the United States Department of Housing and Urban Development, (or other <br />source of subsidy funds) under programs for homeownership (including condomin <br />iums), rental/ or cooperative housing. The proposal shall conform to the guidelines <br />established by the United States Department of Housing and Urban Development <br />with respect to cost limitations, construction and other standards for development <br />of moderate Income dwelling units under the applicable subsidy program(s). <br />The proponent shall furnish any proposal and supporting documents in the form of <br />exchanges of correspondence with responsible officials of the FHA (or other source <br />of subsidy funds), together with affidavits by the proponent reporting its discus <br />sions with such officials, indicating, to the extent then possible, whether there ore <br />uncommitted funds available for projects to develop low and moderate income dwell <br />ing units of the type proposed as well as for other types of units for low and moderate <br />income persons and families. <br />-4 <br />■i <br />ir-J
