The City Council finds that there is insufficient justification to allow the <br /> �rantin� of a side setbacl: variance, and the �ranting of such a variance <br /> would merely serve as a convenience to the applicant and would not be in <br /> l:ee�ing with the spirit and intent of the ZoninQ Code and Comprehensive <br /> Plan. <br /> CONCLUSIONS, OItDER AND CONDITI0�1S <br /> Based upon one or more of the above findings, the Orono City Council hereby <br /> denies a side setback variance for a 4' structure eneroachinent of the required 50' side <br /> setback; and grants a lot area variance to Orono Municipal Zonin� Code Section 78-�68 <br /> to allow construction of a seasonal cabiu on an existing vacant lot consisting of 3.33 acres <br /> of total lot area where appro�imately 1.1 acres of dry buildable area exists and where 5 <br /> acres of dry buildable area is nornially required, subject to the follo«�ing conditions: <br /> 1. Council approval is based on the site plan submitted by the applicant and <br /> annotated by City staff, attached to this Resolution as E�hibit A. Any <br /> amendments to the site plan which are not in conformity with City codes will <br /> require fui-ther Planning Commission and City Council review. <br /> 2. All setbacics; hardcover, structural covera�e, and septic requirements and seibacks <br /> must be met. No variances other than lot area shall be �ranted for construction on <br /> this lot. <br /> 3. Tlus resolution shall also act as a covenant preventing a structure lar�er than 3- <br /> bedrooms. In signing this resolution, the applicant agrees to limit the structure to <br /> 3-bedrooins in order to comply with the 3-bedroom capacity septic sites available <br /> on the lot. The applicant also aQrees to preserve the primar}� and alternate 3- <br /> bedroozn septic sites and prevent them from destruction either durina construction <br /> of the cabin or filture detirelopment on the lot. <br /> 4. Authorities �ranted by this resol�.rtion run ��ith the property not with the <br /> applicants, but are perinissive only and must be exercised by obtaining a buildina <br /> pei-mit fo•.• tl:e neti�- construction ���ithin one year of the date of Council approval, <br /> or the variance will e�pire on that date fOctober 23, 2007). <br /> Pa�z 3 of� <br />
