Tlze conditions that apply to tliis <br /> property are sirriilar to conditions tliat apply to otlter Big Island properties, <br /> with the exception that the p��opei�ty is guided mid used as a public park. <br /> Without the variances a suitable dockage situation fo��public use of this pub[ic <br /> property would�zot be feasible, and reasonable use would be de�iied. <br /> Granting of tlze variances will have no negative impacts and will be in keepi�ig <br /> with the public use intent of the Ciry for tliis property. If the varia�ices are not <br /> granted, tlze City wil[izot be able to provide a safe,functional dockage situation <br /> for this public property. Since access via boat is the only means of access to <br /> the property, tlie iiiability to provide a safe, functioizal access would be a <br /> hardship. <br /> 9. The City Council has considered this application including the findings and <br /> recommendations of the Planning Commission, reports by City staff, comments by <br /> the applicants and the public, and the effect of the proposed variances on the health, <br /> safety and welfare of the community. <br /> 10. The City Council finds that the conditions existing on this property are peculiar to it <br /> and do not apply generally to other property in this zoning district; that granting the <br /> variances and conditional use permit would not adversely affect traffic conditions, <br /> light, air nor pose a fire hazard or other danger to neighboring property; would not <br /> merely serve as a convenience to the applicant and owner, but are necessary to <br /> alleviate a demonstrable hardship or difficulty;are necessary to preserve a substantial <br /> property right of the applicant; and would be in keeping with the spirit and intent of <br /> the Zoning Code and Comprehensive Plan of the City. <br /> CONCLUSIONS, ORDER AND CONDITIONS <br /> Based upon one or more of the above findings, the Orono City Council hereby grants variances to <br /> Orono Municipal Zoning Code Section 78-1282 to allow up to four concrete dock landing pads to be <br /> constructed in excess of the 32 s.f. maximum area normally allowed within the 0-75' zone for <br /> Page 4 of 7 <br />
