This application is regarding variances from lot area, average lakeshore setback, 75-foot <br />lakeshore setback, hardcover within the 75-foot setback, and rear yard setback. <br /> <br />2. MN§15.99 Application Deadline. The application was received on March 7, 2023 and considered to <br />be complete on March 15, 2023. Therefore the 60-Day review period expires on May 17, 2023. <br /> <br />3. Background/ Summary. The applicant is proposing to demolish the existing home and construct a <br />new home on the existing foundation. The existing home and lot are nonconforming. The lot is <br />substandard at 0.66 acres when the LR-1B District requires a minimum of 1 acre. Much of the existing <br />home is located within the 75-foot lakeshore setback, average lakeshore setback and rear yard setback. <br />The current property is also over on hardcover. The proposed project will increase the height and volume <br />of the home with a steeper roof pitch and second story. The project will also decrease the overall <br />hardcover bringing the lot into conformance at 23%. In order to construct the proposed home on the <br />existing foundation variances from lot area, average lakeshore setback, 75-foot lakeshore setback, <br />hardcover within the 75-foot lakeshore setback and rear yard setback are required. The location on the <br />inlet bay creates extreme setbacks resulting in a very small building envelope that cannot support the <br />construction of a new home. The location and substandard size are unique practical difficulties for the <br />property. <br /> <br />4. Planning Commission Vote and Comment. On April 17, 2023, the Planning Commission held a <br />public hearing, no comments were made. The Commission reviewed the application and voted 6 to 0 on a <br />motion to approve the requested variances as applied. <br /> <br />5. Public Comment. The applicant has provided neighbor acknowledgment forms. No other public <br />comment has been received. <br /> <br />6. Staff Recommendation.
