4. <br />5. <br />The Planning Commission must determine if a Conditional Use Permit is appropriate for the <br />site. Does the open space being created allow a CUP to be granted? The Code and <br />Comprehensive Plan allow the PRD to be approved as a land conservation tool and to <br />improve the appearance of neighborhoods. Only one open space outlet is being created and <br />the purpose of the outlet is for wetland and ponding use. <br />The original plan for the site indicated trails being located along Willow Drive and CR 6. <br />The latest plan does not address the need for trails. <br />6. The plan shows lots with the following setbacks. <br />Front Yard Setback <br />Side Yard Setback <br />Rear Yard Setback <br />Side Adjacent to Street <br />35 feet <br />10 feet <br />30 feet <br />35 feet <br />Staff has recommended the lots in Block 1 due to an average lot size of over two acres shall <br />require setbacks for the two acre standard. <br />Staff Recommendation <br />Staff recommends the proposed preliminary plat be approved, but subject to the following <br />conditions: <br />1. <br />2. <br />3. <br />4. <br />5. <br />The conservation easement be platted as a conservation outlot to be held in the ownership <br />of the Homeowner’s Association. A conservation easement would allow a house to be built <br />to the easement boundary, but the property owner would not be allowed to remove or alter <br />any vegetation to the rear of the house. Platting the outlot would ensure houses would be <br />built allowing a minimum setback to the conservation areas. <br />A detailed drainage, ponding and grading plan, with drainage calculations be submitted for <br />City Engineer review and approval prior to City Council review. <br />Detailed Grading, Drainage and Erosion Control plans shall be submitted for review a? <br />requested by the City Engineer (Exhibit F). <br />A drainage area map, storm sewer and ponding calculations should be submitted for review <br />and approval by Staff. All ponds shall meet NURP standards. <br />Trail easements shall be shown along Willow Drive and County Road 6.
