A RESOLUTION <br />DECLARING NORTH ARM LANE <br />OPEN AS A PUBLIC ROAD <br />WHEREAS* the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City of Orono as the local road authority has maintained that <br />roadway known as North Arm Lane as a public road for a period of time in excess of 30 years; and <br />WHEREAS, per Minnesota Statutes SS 160.05 Subd. 1, that portion of North Arm <br />Lane that has not been formally dedicated to the public but which has been used and kept in repair <br />and worked for at least 6 years by the City of Orono, is deemed as a public highway; and <br />WHEREAS, North Arm Lane is located partially on lands dedicated to the public <br />for road purposes in the record plats of North Arm Estates Fourth Addition, Markoe Addition, and <br />North Arm Overlook; partially on lands never formally dedicated as public roadway; and partially <br />on a 33' wide tax parcel to which the City has acquired fee title, such tax parcel being described as <br />PINS #06-117-23 24 0003 and legally described cs: <br />That part of the South 854.5 feet of the Southeast Quarter of the Northwest Quarter <br />of Section 6, Township 117 North, Range 23 West of the 5*ββ Principal Meridian. <br />Hennepin County, Minnesota lying east of the West 280 feet thereof and lying west <br />of the most westerly lines of the plats of Markoe Addition, North Arm Estates Fourth <br />Addition and North Arm Estates, which line is extended in a northerly direction <br />parallel to the West line of said Southeast Quarter to the North line of the South <br />854.5 feet thereof <br />(hereinafter referred to as 'βthe tax parcel β); and <br />WHEREAS, the City of Orono wishes to formalize the public road status of North <br />Arm Lane. <br />Page 1 of 2
