Section 10.32 - Planned Residential Development <br />Summary of Request: <br />The Preliminary Plat application for a seven lot residential development for property located at 120 <br />Brown Road South requires the following approvals: <br />1.A Conditional Use Permit for a Planned Residential Development — This would allow the <br />property to develop at a two acre density using cluster development and preservation space. <br />2.Road width variance and a variance to allow the road to be developed at less than the <br />minimum requirements. Tract G is platted 40' in width where the City requires a minimum <br />platted width for a private residential road to be 50'. Although the plat indicates a 28' paved <br />width the applicant has proposed a 24' width road. The Subdivision Code requires a <br />minimum paved width for property serving 7 or more sites to develop the road at a 28' width. <br />3.The subdivision will require a road crossing of a City Protected Welland and locating a <br />NURP pond within 26' of the City protected wetland. The City Council and the MCWD <br />shall approve any wetland alteration on site. <br />4.The property is located outside of the Metropolitan Urban Services Area (MUSA). A MUSA <br />amendment shall be approved by the City Council and the Met Council to provide sewer to <br />the site. <br />5.The DNR has expressed concerns with the proposed sewer extension to the south end of the <br />project, with the intent of the developer and City to extend sewer under the Luce Line Trail. <br />Mr. Van Ecckhout would install sewer to the south boundary to provide ser\ ice for the Fox <br />Ridge Sewer Project area.
