The plaintiff alleged that the City illegally barricaded Woodhill Avenue and the west entrance to their property. The plaintiff alleged that the City’s actions constituted an unlawful and unconstitutional confiscation of their private property without due process of law. There was no claim payment. However, we did incur $117,3 i 5.32 in legal defense costs. Attached is our computer printout reflecting the payments. As per my letter of July 10, 1998, LMCIT handled this claim as a land use or development litigation. The coverage agreement states that LMCIT will pay 100% of the first $50,000 of defense costs and 85% of the next $200,000 of defense costs. The amount LMCIT pays for damages or defense costs for land use or development litigation is subject to the Municipal Liability Deductible shown in the Municipal Liability Declarations. That deductible is $500.00 per occurrence. In this case, the City’s responsibility is $10.5 97.29. That is based on the $500.00 deductible plus 15% of $67,315.32.
