213944v6 <br />made, along with pertinent employee information necessary for the collection and <br />administration of union dues, preferably in an Excel formatted report that may be <br />electronically transmitted, or by U.S. mail. <br /> <br />The Union shall certify to the Employer, in writing, the current amount of regular dues to <br />be withheld. The Union shall provide the formula or schedule (if applicable) to calculate <br />the actual dues deduction to the Employer and will provide a spreadsheet that can be used <br />to calculate the actual dues, along with any set amount for local assessments, in an <br />electronic Excel format or via U.S. Mail. <br /> <br />5.4 The Union agrees to indemnify and hold the Employer harmless against any and all claims, <br />suits, orders, or judgments brought or issued against the Employer by a union member as <br />a result of any action taken by the Employer under all provisions of this Agreement <br />pertaining to dues or other union approved deductions. <br /> <br />5.5 The Union may designate employees from the Bargaining Unit to act as stewards and will <br />inform the Employer in writing of such choices and changes in the position of stewards <br />immediately. <br /> <br />5.6 The Employer will make space available on a workplace bulletin board for the posting of <br />union notices and announcements and any other pertinent union information. <br /> <br />5.7 With advance notice to the employee's immediate supervisor, the Employer agrees that <br />during working hours, on the Employer's premises, and without loss of pay, the local union <br />business agent or designated union representative shall be allowed reasonable time, which <br />does not unduly interfere with his/her normal duties, to: post union notices and <br />announcements or consult with the Employer, its representative, local union officers, or <br />other union representatives concerning grievances. Employees must keep track of their <br />time spent on union activities during the workday so that time can be reviewed for <br />reasonableness by the Employer. <br /> <br />5.8 The Employer shall permit union officers to utilize employer voicemail and email systems <br />only for the purpose of notifying union members of union membership meetings. Union <br />officials may come onto the Employer’s property to conduct union business, but only after <br />reasonable advanced notice to the Employer and only when it does not interfere with <br />Employees’ work duties. <br /> <br />ARTICLE 6 – EMPLOYER AUTHORITY <br /> <br />6.1 The Employer retains the full and unrestricted right to operate and manage all manpower, <br />facilities and equipment; to establish functions and programs; to set and amend budgets; to <br />determine the utilization of technology; to establish and modify the organizational <br />structure; to select, direct and determine the number of personnel; to establish work <br />schedules, and to perform any inherent managerial function not specifically limited by this <br />Agreement. <br />
