Overtime shall be paid at one and one half (1-1/2) times employee’s <br />regular rate of pay. <br /> <br />3.7 CALL BACK: Return of an employee to a specified work site to perform assigned duties <br />at the express authorization of the Employer at a time other than a scheduled shift. An <br />extension of or an early report to a scheduled shift is not a call back. <br /> <br />3.8 COMPENSATORY TIME: Time off the employee's regularly scheduled work schedule <br />pay that is in lieu of cash overtime. <br /> <br />3.9 IMMEDIATE FAMILY: Means Mother, Father, Legal Guardian, spouse, son, daughter, <br />brother or sister. <br /> <br />3.10 PROBATIONARY PERIOD: Means minimum six (6) months of continuous employment <br />up to twelve (12) months with an extension period not to exceed six (6) months. Employer <br />shall notify the union with all extensions over twelve (12) months. The City may terminate <br />a Probationary Employee any time in its sole discretion. <br /> <br />3.11 RESIGNATION IN GOOD STANDING: An employee leaving service with the Employer <br />after giving 14 days written notice stating the effective date, providing the employee has <br />not been discharged for misconduct. <br /> <br />ARTICLE 4 – EMPLOYER SECURITY <br /> <br />4.1 The Union agrees that during the life of this Agreement neither the Union, its officers or <br />agents, nor any of the employees covered by this Agreement, will engage in, encourage, <br />participate in, or support any strike, sympathy strike, slowdown, or other interruption of or <br />interference with the normal functions of the Employer, except as specifically allowed by <br />Public Employment Labor Relations Act of 1971, as amended. <br /> <br />ARTICLE 5 – UNION SECURITY <br /> <br />5.1 The Employer shall deduct an amount sufficient to provide the payment of regular dues <br />and/or other union approved deductions, established by the Union, from the wages of <br />employees authorizing, in writing, such deduction on a form mutually agreed upon by the <br />Employer and the Union. The deduction of dues shall commence 30 working days after <br />initial employment with the Employer. <br /> <br />5.2 All Employees who have completed thirty (30) calendar days of employment shall become <br />members of the Union and shall maintain their membership in good standing. “In good <br />standing,” for the purpose of this Agreement, is defined as to mean the payment of a <br />standard initiation fee and standard regular monthly and or administrative dues uniformly <br />required as a condition of acquiring or retaining membership in the Union. <br /> <br />5.3 The Employer shall remit such deduction to International Union of Operating Engineers <br />Local No. 49, with a list of the names of the employees from whose wages deductions were
