A RESOLUTION GRANTING AN <br />AMENDMENT TO A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.03, SUBDIVISION 9 (D) <br />FILE #2519 <br />WHEREAS, Matthew A. Staloch and Robin J. Staloch (hereinafter "the <br />applicants") are owners of the property located at 4705 Watertown Road within the City of <br />Orono (hereinafter "City") and legally described as follows. <br />Exhibit A attached, Hennepin County, Minnesota (hereinafter "the property"); and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 20, 1999, at which times all persons desiring <br />to be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the City Council approved a variance to permit a 28 ’x40’ accessory <br />structure on September 27, 1999; and <br />WHEREAS, the applicants have applied to amend a previously approved <br />variance to Municipal Zoning Code Section 10.03, Subdivision 9 (D) to permit construction <br />of a 30'x40' accessory structure between the principal building and the street where no <br />accessory structures are to be allowed. <br />NOW, THEREFORE, BE IT RESOLVTD by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #2519. <br />2. The property is located in the RR-IA Zoning District, where 5 acres or 217,800 <br />s f is the minimum lot area.
