This application requires the following conditional use permit: <br />► Section 10.56 Shoreland Management, Subd. 16. Shoreland Overlay District Standards, (J) <br />Topographic Alterations/Grading and Filling (2) Grading, filling or excavating of more than <br />10 cubic yards is prohibited within 75’ of the Ordinary High Water Level of the public waters <br />enumerated in Section 7 of tliis section. Grading, filling, or excavating of 10 cubic yards or <br />less shall require City staff review and permit and be subject to other pertinent sections of <br />the Zoning Code. A conditional use permit is required to allow more than 500 cubic <br />yards of fill on the property (1,300 cubic yards). All regrading will be outside of the 75' <br />lakeshore setback. <br />STAFF RECOMMENDATION <br />Staff recommends approval of the application for Conditional Use Permit for fill of greater than 500 <br />cubic yards and hardcover of 9,613 s.f. in the 75-250' lakeshore setback subject to the conditions <br />noted in the attached resolution. <br />PLANNING COMMISSION RECOMMENDATION <br />On a vote of 6 to 0 the Planning Commission recommended approval of the conditional use permit <br />for 1,300 cubic yards of fill with the understanding no grade changes will occur within the 0-75' <br />setback, and to grant a hardcover variance to permit 25.7% hardcover based on the revised site plan <br />submitted by the applicants. The total hardcover will be reduced in the 0-75' lakeshore setback and <br />the 75-250' lakeshore setback. <br />COUNCIL ACTION REQUESTED: <br />To approve or amend the enclosed resolution. <br />P
