2" average diameter trees will be planted in the locations indicated on the most revised restoration <br />plan. Dr. Bedker has indicated this size tree will likely be successful in achieving stability within <br />two years of planting. Restoration of the site shall begin no later than Spring, 2000. The City <br />Attorney has recommended executing a contract or Restoration Agreement with the property owners <br />giving the City rights to inspect the property following restoration planting and annual site <br />inspections for a period of 6-8 years. The purpose of the site inspections is to ensure a successful <br />restoration program and ensure the bluff is not subject to any erosion problems. <br />Hardcover and Shoreland Land Alteration <br />The original landscaping plan submitted by the applicants had indicated a series of retaining walls <br />and extensive land alteration. Based on recommendations by the City Engineer and Planning <br />Commission the retaining walls and land alteration were mostly eliminated from the plan. The only <br />hardcover and grading would occur at the base of the proposed stairway. However it would be <br />located within 75' of the lakeshore requiring a variance for hardcover and a conditional use permit <br />for grading. The amount of hardcover and grading is minimal and only enough to stabilize the base <br />of the stairway. <br />A summary of the existing and proposed hardcover on the lot are attached to this memo as Exhibits <br />D1-D4. The additional hardcover within 75 ’ of the lake are a result of 50 s.f for the retaining walls. <br />The Shoreland Ordinance allows stairways as a preferred alternative to major topographic alterations <br />for achieving access up and down bluffs and steep slopes to shore areas. The applicants have <br />proposed a stairway 5' wide, however the Ordinance only allows stairways 4' in width. Staff is <br />recommending the proposed stairway be reduced 1' to comply with the ordinance and decrease <br />potential hardcover on the property. <br />This application requires the following variances: <br />1.Section 10.22, Subd. 2 and Section 10.56, Subd. i6 (L)(2): Lakeshore Hardcover and <br />Land Alteration Regulations: Within 75 feet of the shoreline (929.4') there shall be no <br />excavating, filling, hardcover, temporary or permanent structures. Within 75 to 250 feet of <br />the shoreline there shall be no greater than 25% hardcover. Within 250 to 500 feet of the <br />shoreline there shall be no greater than 30% hardcover. The proposed plan would increase <br />the amount of hardcover in the 0-75' setback from 60 s.f. (0.5%) to 200 s.f. (1.5%) to allow <br />a series of retain walls along the bluff. The amount of hardcover would also slightly increase <br />within the 75-250' setback. No variance is required as the total hardcover would be 24.4%. <br />This application requires the following Conditional Use Permit: <br />1.Section 10.03, Subdivision 19: A Conditional Use Permit is required to allow the grading <br />and placement of retaining walls within the lakeshore setback. Vegetation must be made <br />available to adequately screen structures, including buildings and retaining walls, from public <br />waters. The proposal would slightly modify the natural grade within the 75' lakeshore <br />setback, requiring a Conditional Use Permit.
