9.2 <br />9.3 <br />9.4 <br />decks, garage doors (except hardware), and exterior siding and other building surfaces, <br />and (ii) provide for lawn, shrub and tree maintenance on all Units; (iii) provide for <br />snow removal from driveways, walkways and parking areas for all Units. The <br />Association's obligation to maintain exterior building surfaces shall exclude patios, <br />entry doors, door hardware, air conditioning equipment, glass and window fra.mes, and <br />any other items not specifically referred to in this Section, unless otherwise approved <br />under Section 9.3. The Association shall have easements as described in Section 13 <br />to perform its obligations under this Section 9. <br />Maintenance of Ponding Areas. The Association shall maintain any ponding areas <br />upon the Property as located and shown on the final development plans and the plat on <br />file with the City of Orono. Maintenance of the ponding areas shall be in accordance <br />with the City of Orono Municipal Code. The cost of such maintenance shall be <br />assessed pro-rata against all Units on the Property in accordance with Section 6 of this <br />Declaration. In the event the City determines that the ponding areas are not being <br />properly maintained, after due notice to the Association as provided in Section 16.4 of <br />this Declaration, the City may undertake the required maintenance and assess the cost <br />of such maintenance to die Association or the Units as provided in Section 16.6 of this <br />Declaration. <br />Maintenance of Private Drive. Outlot A, Lake Minnetonka Woods, a Common <br />Element, shall be maintained by the Association as a Private Drive. Maintenance shall <br />include construction, reconstruction, resurfacing, snow removal, sanding and salting, <br />as necessary, lighting, striping and curbing as the Owners shall determine necessary; <br />provided, however, that all maintenance shall be conducted in compliance with all <br />applicable provisions of the City of Orono Municipal Code (the "Code"). Declarant <br />shall be responsible, at its expense, for initial construction of the Private Drive, which <br />shall in all respects conform to the requirements of the City of Orono. All future <br />maintenance shall be conducted by the Owners or their contractors, at Owners’ <br />expense. The cost of such maintenance shall be assessed pro-rata against all Units on <br />the Property in accordance with Section 6 of this Declaration. In the event the City <br />determines that the Private Drive is not being properly maintained, after due notice to <br />the Association as provided in Section 16.4 of this Declaration, the City can undertake <br />the required maintenance and access the cost of such maintenance to the Association <br />or the Units as provided in Section 16.6 of this Declaration. <br />Optional Maintenance bv Association. In addition to the maintenance described in <br />this Section the Association may, with the approval of a majority of votes cast in <br />person or by proxy at a meeting called for such purposes, undertake to provide <br />additional exterior maintenance to the Units or Dwellings, or maintenance of water and <br />sewer systems within the Units.
