Longridge Associates agreed to <br />deed the trail right-of-way to DNR in exchange for conveyance to Longridge of a portion of the Trail <br />right-of-way further east, adjacent to the Orono Orchard Road bridge. The portion to be conveyed <br />to Longridge is now (and will continue to be) used by DNR and the public as a walking/driving <br />access to the trail; DNR will be retaining an easement over the strip for these purposes. <br />Longridge already owns a strip of land between the Orono Golf Course and the Luce Line (see <br />Exhibits A and B). The conveyance gives Longridge additional frontage on Orono Orchard Road <br />adjacent to the bridge. <br />DNR Exempt From Subdivision Regulations <br />DNR is claiming exemption from compliance with Orono Zoning Code requirements in this matter, <br />and had discussed this with Liz Van Zomeren earlier this year. City Attorney Tom Barrett concurs <br />that the City cannot require DNR to comply with our subdivision requirements. <br />Hennepin County will eventually request confirmation of City approval of this division before their <br />maps and tax records are changed. Therefore, staff is requesting authority to advise the County that <br />the City will not oppose this 'lot line rearrangement subdivision'. Additionally, it is important that <br />the County and Longridge be advised that the conveyed parcel should be legally combined with the <br />adjacent Longridge parcel to avoid the creation of what someone might perceive as a buildable lot. <br />f <br />r \ <br />I
