- • • <br />In order to place a fence along the South property line, variances from several codes would <br />be required. The Shoreland Overlay District does not allow any unsewered structures within 100' <br />of the OHWL. Other variances include height, as in side yards no fence over 42" may be located <br />closer to the shoreline than the average distance from the shoreline of existing residences on <br />adjacent lots. <br />Staff is also unsure as to the need for a fence for the entire proposed area, as a significant <br />portion of the fence will run along the wooded area on the south property line. The only place the <br />proposed fence could be placed without a variance is in the side and rear yard. <br />Variances from the following ordinances: <br />1. Section 10.22, Regulations for "LR-IA"..., Subd. 1, Lakeshore Set Back Regulations, (B) <br />No principal or accessory structure shall be located within 75 feet of the lakeshore nor closer to the <br />lakeshore than the average distance from the shoreline of existing residence building s on adjacent <br />lots except that this does not apply to structure allowed in subsection A above. <br />2. Section 10.03, General Provisions, Subd. 15, Non-Encroachments, (D) Side Yards <br />In side yards, no fence or over 42 inches m height above original grade may be located closer to the <br />shoreline than the average distance from the shoreline of existing residence buildings on adjacent <br />' lots, such fences shall not be constructed within 75 feet of the shoreline, (pg 256) <br />3. Section 10.56, Shoreland Management, Subd. 16, Shoreland Overlay District Standards, (C) <br />Placement of Structures bn Lots, (1) Setbacks from OHWL, (5) Fences, Docks, Retaining Walls, and <br />(6) Average Lakeshore Setback. Number (1) states: Structure setbacks from the Ordinary Hi^ <br />Water Level: Long Lake is classified as a Recreational Development Lake, vduch has a 100* setback <br />for unsewered structures. Number (5) states: No fence shall be placed witiun the shore .<;etback <br />zone.
