••4 • <br />TO:Chair Hawn and Orono Planning Commission Members <br />• Ron Moorse, City Administrator . <br />FROM:Kris Jenson, Assistant Zoning Administrator/Planner <br />DATE: July?, 1999 . <br />SUBJECT; #2504 - Warren & Tana Garrett, 650 Brown Road North <br />Variance Request <br />Zoning District: LR-IA <br />Application:The applicant proposes to in«rtall a 3 rail, split-rail fence, 5' in height, along <br />the south property line to the lakeshore as well as a home addition, a deck <br />addition and an inground swimming pool with decking around the pool, all <br />located between the house and the lake. <br />STAFF SUMMARY <br />Firstj the applicants are planning an addition to the Northeast comer of the home. The. <br />addition is 12* x 20* and will line with the existing North wall of the home and the existing East <br />side of the deck. <br />Second, the aj^licants are proposing a deck addition and inground swimming pool. The total <br />surface area of the additions, along with the eristing hardcover in the 250-500' will not exceed 30%. <br />The proposed deck addition will be added to the souUieast comer of die' existing deck, widi die <br />inground pool located approximately 30' east of the existing deck. The variance reqiured for diwe <br />items is the average lakeshore setback. Since the applicant’s home is located closer to the lake than <br />either of its neighbors, the average lakeshore setback is their existing home, or approximately 385'. <br />Along the north and south property lines are mature stands of trees that buffer the view to either <br />property owners to the north and south. Staff feels that the proposed location is the most lo^cal, <br />and it >^^1 not block or interfere with the view of either nei^bor towards the lake. <br />Finally, the applicants are proposing a 3-rail, split rail fence, no more than 5' in height, to run <br />along the south proper line, from the driveway to the lakeshore, approximately 790 ’ in length. The <br />applicants want a fence due to the fact that the neighboring lakeshore owner to the soudi is a Long <br />Lake City Park, and the applicant's have had people trespass on their property and dock. The <br />applicant's feel Aat the proposed fence will be high enough to deter trespassers, but will not block <br />the view of the townhome owners. The President of the West Shore Townhome Association has <br />written a letter to the City protesting any fence being erected on the applicants property.
