r <br />5. <br />6. <br />7. <br />8. <br />9. <br />Provision of evidence of stormwater management plan approval from the Minnehaha <br />Creek Watershed District. <br />Dedication to the City of public roadway for North Arm Lane and Nordi Arm Drive <br />West. <br />Granting of a partial temporaiy cul-de-sac easement over the northeasterly portion <br />of Lot 1. <br />Creation of covenants for Lot 1 for protection of drainfield sites, including protective <br />language for alternate septic sites along with site plans locating both primary and <br />alternative sites, and alerting future property owners of the need to protect sites on <br />adjacent properties. <br />Execution of a Subdivider's Agreement providing for the installation of drainage and <br />stormwater facilities required as a condition of subdivision approval, and posting of <br />security to ensure that these required improvements are completed to the City's <br />satisfaction, the design of said improvements subject to approval of the City <br />Engineer. <br />10. Payment to the City for the final plat review fee and fee for legal review and filing <br />of the plat, easements and covenants in the amount of $400.00. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono <br />hereby approves the plat of North Arm Overlook, Hennepin County, Minnesota, subject to the <br />following conditions; <br />1.Prior to release of the plat for filing, applicant shall provide to the City evidence of <br />an access easement in favor of applicant's property over the 33* privately owned <br />corridor adjacent to the east side of the property; except that at such time that a road <br />and utility easement over (or fee title to) the 33' corridor is obtained by the City, this <br />condition shall become null and void. <br />Page 2 of 4 <br />J
