9. Authorities granted by this conditional use permit run with the property not with the <br />applicant. <br />10. Violation of or non-compliance with any of the terms and conditions of this resolution shall <br />constitute a violation of the Zoning Code per Section 10,09, Subdivision 12 and Section <br />10.99, and may terminate any authority granted herein, after review by the Council. <br />11. The undersigned applicant has read and understood the terms of this resolution, hereby <br />agrees to Conditions 1-10, and on behalf of itself, its heirs, successors and assigns, hereby <br />agrees to the recording of this resolution in the Chain of Title of the Property. <br />12. The applicant asserts that its acknowledgement of this Resolution and agreement to its <br />conditions does not waive and is without prejudice to applicants claim of right to use the <br />Woodhill Avenue access without limitation and without amendment of its 1968 CUP, a claim <br />which the City denies. <br />13.
