§ 6.05 <br />Subd. 2. Requirement and Application for Permit. It is <br />a misdemeanor to construct or reconstruct a sidewalkr curb and <br />gutter, driveway, driveway approach, driveway turnaround, curb <br />cuts, roadway surfacing or any other private improvement in any <br />public road or other public property in the City without a "permit <br />in writing from the City. Application for such permit shall be <br />made on forms approved and provided by the City and shall <br />sufficiently describe the contemplated improvements, the <br />contemplated date of beginning of work, and the length of time <br />required to complete the same, provided that no permit shall be <br />required for any such improvement ordered installed by the Council. <br />Such application shall also contain information showing the type of <br />construction, the width and the location of an improvement on the <br />parcel of land and the lot and block number or the parcel number <br />and the street and house number and a profile of the proposed <br />improvement, if necessary, and other such information as may be <br />required by the Public Works Director. The application shall be <br />filed by the property owners desiring to construct such a driveway <br />approach, driveway turnaround, sidewalk, curb and gutter, driveway, <br />curb cut, roadway surfacing or private improvements in any public <br />xoad or any property in the City, or by his or her duly authorized <br />agent. All such applications shall contain an agreement by the <br />applicant to be bound by this Chapter. A permit from the City <br />shall not relieve the holder from deutiages to the person or property <br />of another caused by such work. These regulations shall apply to <br />all City, State and County Roads. <br />Subd. 3. Issuance of Permit. Such permit shall be <br />issued by the Public Works Director, if he or she has determined <br />that the applicant has complied with the terms of this ordinance, <br />the permit fee hereinafter specified has been paid and the Public <br />Works Director has approved the driveway, driveway approach, <br />driveway turnaround, sidewalk, curb and gutter, curb cuts, roadway <br />surfacing or private improvement in any public road or other public <br />property in the City as requested or with stipulated changes. The <br />Public Works Director shall have the authority to refuse to issue a <br />permit when, in the judgement of the Public Works Director, the <br />requested construction would impose an unreasonable hazard to the <br />public. Such decision may be appealed in writing by the applicant <br />to the City Council. The City Council shall have the power to <br />affirm, reverse or modify the decision of the Public Works <br />Director. <br />Subd. 4. Permit Fees.
