Mayor and City Council <br />May 4,1999 - <br />Page 11 <br />5. Expansion of Woodhill ’s west driveway between the maintenance building and <br />Woodhill Avenue. <br />6. Bituminous paving of the driveway abutting Woodhill Avenue <br />7. Signage concerning Woodhill on Orono Orchard Road. <br />The Club further requests either amendment to the 1968 conditional use permit or <br />acknowledgment by resolution that the right of access to the Woodhill property exists <br />independent of any conditional use permit process in the following two circumstances: <br />“1. Under the terms of the Easement Agreement.” That agreement, and the duties of <br />parties thereunder, speaks for itself and need not be part of any conditional use permit at this time <br />but since it benefits only one lot it has a minimum effect on safety. <br />“2. If all access from Woodhill to County Road 15 is permanently blocked as a result <br />of either Highway 15 alteration or improvement or because of the railroad right- <br />of-way, the right of reasonable access to the Woodhill Property is required and is <br />not subject to revocation through the conditional use permit process.” <br />If that situation ever develops, the Club must apply for a conditional use permit so the <br />City can decide if such use is warranted and if so, what conditions must be imposed in order to <br />protect the health, safety and welfare of the citizens in the area and the users of the roads. <br />Moreover, there may be other solutions to such a theoretical future problem as to access onto <br />County Road 15. For example, if the railroad ever lawfully closes the access to County Road 15, <br />the City could condwtui the access as a public road to a point where the road enters upon the <br />Club’s property. <br />H. If the City decides that Access should be allowed onto Woodhill Avenue now, in addition <br />to the Access set forth in Section G above, the City should require the followine: <br />1 .
