Spring Hill will, At its constnict m tnul along Spring HUl Road west of Bast <br />Long Lake Road and nords on Tamarack to Wetland Number 12, with the following characteristics: <br />(a) The trail will be for pedestrian and cross-country aiding use and will not be <br />designed for bicycles or snowmobiles. <br />(b) The trail clearing will be approximately four feet wide. <br />(c) Wood chips, ifrequested by die City» will be provided as the traveled surface. <br />4. Ihe trail on Tamanck Drive coinmencing at Wetland Number 12 and north will be <br />suldect to ftituie design and construction. <br />5. In addition to the construction undertaking above. Spring Hill will contribute up to <br />$20,000 towards trail construction in die vicinity of the golf course. <br />6. .. City staffand engineers will participate in the layout and engineering ofthe trail, at <br />the. City's expense. City will be responsible for obtuning all permits required for the trail. <br />7. Spring Hili agrees to tnmsfer to the City two-diirds of die excess weUand mitigadon <br />credits resulting ftom constniction of the golf course in Orono. The credits will be for trail <br />system and, to the extent any remain, will be available to the City of Orono. The remaining one- <br />third will be retained by Spring Hill for possible future modificatioas of the golf course, subject to <br />applicablt laws government approvals. Spring Hill agreca not to sell or otherwise tzanafer these <br />credits from die golf course site. <br />8. Spring HUiinay construct a! its expense, a rustic ^lit rail fence between the IraD and <br />the golf course on those locadons where, for safety and sqporatlon reasons, planting and berming is <br />not foarible. Spring Hill will not construct any fence which will prevent the free movement of wild <br />life in the area of the golf course. <br />9. The City will have le^nsibility for maintenance and repair of the trail after initial <br />eonstfuetion. <br />e <br />10. Spring Hill will not be obligated to complete construction ofthe trail until completion <br />of the golf course. The parties agllcipate that the trail will be ready for use concurrently with the <br />opening of the golf course. The flnal design of the trail system will be determined after the final <br />grading plans have been determined and after the rough grading for the golf course has been <br />ooixqrleted. <br />11. The restrictions on the Orono Trail set forth herein shall restruict only that portion <br />of die trail on the right-of-way donated by Spring HUl and shall not restrict the City's trail on its <br />Page 2 of3
