NO. 4S62o5So4o P 5 <br />srrD <br />luesoLtmON no . 3902 <br />•’TRAIL AGREEMENT <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />THIS AGREEMENT, made and entered into thia day o f — . 1997, <br />by and between the City of Orono , a municipal coiporation organized unde^^i^laws of the State <br />of Minnesota (hcielnaftcr uJled Xity") and Spring HiU Golf Club, a Minnesota nonprofit <br />eerpemdoa, its heizs, suoeesaors end assigna, (hereinafter called ’•Spring Hill”) <br />'WITNESSETH: <br />WHEREAS, Spring HUl has made application to the City Council for approval of the <br />construction and operation of a golf course; and <br />WHEREAS, (be City Council has granted approval for such development on the condition <br />that Spring 1^ av UI pro^de certain easements and construction activities and centralize certain costs <br />for the City's trail system on the perimeter of the Spring Hill property. <br />NOW THEREFORE, in consideration of the premises, «nd of one dollar and other good <br />and valuable consideration, it is hereby agreed as follows: <br />1. Spring RBU will deed to die City for nominal consideration an easamcDt to extend die <br />City's right-of-wny ^iproximately ten feet north ’>s cxi** right-of-way along Spring HUl Road <br />ftom East Long Lalce Road to County Road ^ Mi feet east of the iight*of^way of Tamarack <br />Drive fiom County Road 6 to the City line. In some eases, more than ten feet will be required. The <br />precise esqjanrion of the right-of way will vary depenefing on the topography and may in some cases <br />exceed or be leas then ten feet. Any modificadon of die ten feet easement refhrred to in this <br />paragraph is subject to mutual agraameot of the City and Spring Hill. <br />2. Orono will design a trail system within the City right-of-way, as expanded, which <br />trail system to the extent It b on the right-of-way donated by Spring Hill will be subject to the <br />reasonable approval of Spring Hill. It is the intent of the parties that the proposed trail provide a <br />scenic bff*road pedestrian and cross-countiy ski trail with minimum impact upon Golf Club and <br />without hazardous conditions for the trail users. <br />Page 1 of 3 <br />1
