6.The interests of the Navarre Cove Homeowners Association (NCHA) in Outlot A, Navarre <br />Cove shall be extinguished, and Outlot A, Navarre Cove and Lot 3, Navarre Cove shall be <br />legally combined. <br />7.Regardless whether the combination of Lot 3 and Outlot A, Navarre Cove ("Hoyt property") <br />is ultimately developed for use as a single family residence or a duplex, there shall be no <br />more than 2 dock slips provided within the lagoon for the Hoyt property. The owner of the <br />Hoyt property shall execute a deed restrictive covenant to this effect. The owner of the Hoyt <br />property shall obtain a one-time building permit for consUiiction of a new 2-slip seasonal <br />dock within the lagoon, subject to City staff approval, and may annually place said dock in <br />kind without obtaining an annual permit. <br />8.Applicants shall comply with any legal requirements that may be established .by the City <br />Attorney in his memo to Kelly Cova nd Navarre Cove Homeowners dated April 20,1999 <br />and any other legal requirements the City Attorney may subsequently establish. <br />9.The City will issue a 1999 Annual Joint Use Dock License to Kelly Cove Homeowners <br />Association subject to completion of all requirements of this Resolution. No such license <br />shall be issued for year 2000 or subsequent years unless/until the conditions of this <br />Resolution are complied with. <br />Adopted by the City Council of Orono this 26th day of April, 1999. <br />ATTEST: <br />Linda S.
