The condicion in Resolution No. 1621 that prohibits the construction of residential <br />docks on the shoreline of Outlot A, Kelly Cove, must be amended in order to allow <br />construction of such docks, and the condition of Resolution No. 1621 that continues <br />in effect the conditions of Resolution No. 1058 regarding use of Outlot A, Navarre <br />Cove as a joint use dock area serving all 6 units, must also be amended. <br />10. It is appropriate that the KCHA be the beneficiary of a deed restriction over Lot 3, <br />Navarre Cove and Outlot A, Navarre Cove limiting the owner of said Lot and Outlot <br />to 2 slips, to protect the lake views and navigability enjoyed by KCHA members once <br />said Outlot is no longer under KCHA control. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota <br />hereby approves the creation of a new joint use dock area to serve Lots 1 through 4, Kelly Cove, <br />subject to the following conditions; <br />1.A new joint-use dock shall be allowed to extend fi’om Outlot A, Kelly Cove ("the commons") <br />into Outlot B, Navarre Cove ("the lagoon") to serve the 4-unit Kelly Cove Homeowners <br />Association, subject to an annual Joint Use Dock License per the licens,' requirements of the <br />Orono Municipal Code. <br />2.The new joint-use dock shall be of a length, width, configuration and location to be reviewed <br />annually as part of the annual Joint Use Dock License review process. <br />3.The existing flowage & conservation easement ever Outlot A, Kelly Cove shall be amended <br />to allow for said dock construction, and the City shall accept such amendment. <br />4.The approval conditions of the plats of Navarre Cove (Resolution #1028) and Kelly Cove <br />(Resolution #1621) shall be amended by the City to allow for the proposed KCHA joint use <br />dock. <br />5.The Kelly Cove Homeowners Association and its individual members shall extinguish their <br />easement rights over and across Lot 3 and Outlot A, Navarre Cove. Further, the KCHA shall <br />execute covenants limiting KCHA to no more than 4 slips in the lagoon, 1 for each of the 4 <br />KCHA dwelling units. <br />Page 5 of 9
