The existing residence is a non-conforming structure as it is <br />located on an undersized lot and encroaches into the required side yard setback. The house is located <br />on the lot line. The new structure would be placed to meet all required setbacks. <br />The lot is located in the LR-IC zoning district where 1/2 acre is the minimum lot size required for <br />new construction. The zoning district also requires 100' lot width for new construction. The zoning <br />code does allow certain lots to be record lots if the following conditions are met: <br />In "R" Districts of One Acre or Less and With Public Sanitary Sewer. A lot of record <br />existing upon the effective date of this Zoning Chapter in any "R" District of the City of up to and <br />including one acre, which lot is serviced by public sanitary sewer and which does not meet the <br />requirements of this Zoning Chapter as to area or width only, may be utilized for single family <br />detached dwelling purposes without Council approval if the area measurements and width of that <br />lot are within eighty percent (80%) of the requirements of this Zoning Chapter. How ever, the lot of <br />record shall not be more intensely developed unless combined with one or more abutting lots or <br />portions thereof so as to create a lot meeting the requirements of this Zoning Chapter. <br />(Section 10.03, Subdivision 6 (A) (1)) <br />The applicants intend to retain the existing garage located on Birch Lane at the rear of the lot. <br />Typically the zo^mg code does not allow any accessory structures to remain on a lot without a <br />principal building. To meet the Planning Commission recommendation the applicants have prepared <br />a site plan reducing the size of the garage from 30' x 22' to 20' by 22'. <br />S <br />4
