f I <br />pWfitti <br />A RESOLUTION GRANTING A CONDITIONAL USE PERMIT <br />FOR A MIDDLE SCHOOL AT 800 OLD CRYSTAL BAY ROAD NORTH <br />FOR ORONO INDEPENDENT SCHOOL DISTRICT #278 <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.28, SUED. 3 AND SECTION 10.03, SUED. 19-21 <br />FILE #2471 <br />WHEREAS, Orono Independent School District #278, (hereinafter "the <br />applicant") on February 17, 1999, filed an application for a conditional use permit to allow <br />construction of a new middle school to serve 675 students in grades 6-8 and for land alteration <br />to grade/fill with 14,000 cubic yards of fill for property located at 800 Old Crystal Bay Road <br />North within the City of Orono (hereinafter " City") and legally described as; <br />Lots 1 and 2, Block 1; Outlot A, and Lots 1 and 2, Block 2, Orono School Expansion, <br />Hennepin County, Minnesota; and <br />WHEREAS, the applicant has applied to the City of Orono for a conditional use <br />permit to construct a new 2-story building with a 72,976 sq. ft. footprint and approximately <br />115,000 sq. ft. of floor area for a new middle school serving 675 students in grades 6-8 per <br />Section 10.28, Subd. 3, and to allow land alteration of the site by moving, grading or filling <br />requiring approximately 14,000 cubic yards of fill per Section 10.03, Subd. 19-21. <br />WHEREAS, after due published and mailed notice in accordance with the City <br />of Orono ’s Zoning Code, the Orono Planning Commission held a public hearing on March 15, <br />1999, at which time all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon; and <br />WHEREAS, at their regular meeting on April 12, 1999, the Orono City Council <br />considered the application noting the following findings of fact: <br />Page 1 of 11 <br />i
