The concrete front stoop is located over a basement <br />C. The subject property does not currently meet the lot area requirements. <br />D. The City has received no comments from the property owners notified <br />of the proposed improvement. <br />4.The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstndile hardship or diff. .ty; is necessary to preserve a. substantial <br />property right of the applicant; and would be in keeping with the spirit and <br />intent of the Zoning Code and Comprehensive Plan of the City. <br />5.The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, conunents <br />by the applicant and the effect of the proposed variance on the healtii, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Coimcil hereby <br />grants a side yard setback variance per Municipal Zoning Code Section 10.25, Subdivision 6 <br />to permit construction of a front entry stoop over an existing concrete slab; per Section 10.56, <br />Subdivision 16 (c) an average lakeshore setback variance to allow a deck to encroach 20' into <br />the average lakeshore setback; and per Section 10.22, Subdivision 2, to allow a hardcover <br />variance in the 75-250' setback area to increase hardcover from 3,420 sq. ft. (32.26%) to 3,637 <br />sq. ft. (34.3%) where 2,680 sq. ft. or 25% is allowed, subject to the following conditions: <br />Page 2 of 4
