:v <br />CITYof ORONO <br />RESOLUTION OF THE CITY COUNCIL <br />NO. a s 9 1 _ <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.25, SUBDIVISION 6, <br />SECTION 10.22, SUBDIVISIONS 1 (B) AND 2 AND <br />SECTION 10.56, SUBDIVISION 16 (C-6) <br />FILE NO. 2227 <br />'WHEREAS, Gary Tucker (hereinafter "the applicant") is the owner of the <br />property located at 3466 Ivy Place within the City of Orono (heremafter "the City") and legally <br />described as follows: <br />Lot 1, Spring Park, including that part of vacated Lake Shore <br />Avenue lying between the extensions of the north and south lines <br />of said Lot 10 (hereinafter "die property"); and <br />WHEREAS, the applicant has applied to the City for a variance to Municipal <br />Zoning Code Section 10.25, Subdivision 6, Section 10.22, Subdivisions 1 (B) and 2, and <br />Section 10.56, Subdivision 16 (C-6) to allow for a side yard setback to encroach along tne <br />north property line and to increase hardcover in the 75-250' setback area. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />1. This application was reviewed as Zoning File #2227. <br />2. The property is located in the LR-IC Single Family Lakeshore Residential <br />Zoning District where one-half acre in area is required. The property is sewered. <br />3. . The Orono Planning Commission reviewed this application on April 21, 1997 <br />and recommended approval of the proposed variance based upon the following <br />unique findings and hardships: <br />Page 1 of 4
