CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants an amendment to the side yard setback variance per Municipal Zoning Code Section <br />10.25, Subdivision 6 to permit construction of a front entry stoop over an existing concrete <br />slab; per Section 10.56, Subdivision 16 (c) an average lakeshore setback variance to allow a <br />deck to encroach 20' into the average lakeshore setback; and per Section 10.22, Subdivision <br />2, to allow a hardcover variance in the 75-250' setback area to increase hardcover from 3,420 <br />sq. ft. (32.26%) to 3,637 sq. ft. (34.3%) where 2,680 sq. ft. or 25% is allowed, subject to the <br />following conditions: <br />1.Authorities granted by this variance run with the property not with the applicant, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this amendment will <br />expire on that date (March 22, 2000). <br />2.Violation of or non-compliance with any of the terms and conditions of this <br />variance amendment shall constitute a violation of the zoning code, shall <br />automatically terminate any authority granted herein, and shall be punishable as <br />a misdemeanor. <br />3.The undersigned applicant has read, understood and hereby agrees to the terms <br />of this resolution and on behalf of himself, his heirs, successors and assigns, <br />hereby agrees to the recording of this resolution in the Chain of Title of the <br />property. <br />Adopted by the City Council of the City of Orono, Minnesota at a regular <br />meeting held on the 22nd day of March, 1999. <br />ATTEST: <br />Carole A.
