A RESOLUTION GRANTING AN AMENDMENT TO <br />A VARIANCE TO MUNICIPAL ZONING CODE <br />SECTION 10.25, SUBDIVISION 6, <br />SECTION 10.22, SUBDIVISIONS 1 (B) AND 2 AND <br />SECTION 10.56, SUBDIVISION 16 (C-6) <br />FILE NO. 2227 <br />WHEREAS, Gary Tucker (hereinafter "the applicant") is the owner of the <br />property located at 3466 Ivy Place within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />Lot 1, Spring Park, including that part of vacated Lake Shore <br />Avenue lying between the extensions of the north and south lines <br />of said Lot 10 (hereinafter "the property"); and <br />WHEREAS, the applicant was approved for variances (Resolution No. 3891) to <br />Municipal Zoning Code Section 10.25, Subdivision 6; Section 10.22, Subdivisions 1 (B) and <br />2; and Section 10.56, Subdivision 16 (C-6) to permit a side yard setback encroaching along <br />the north property line 8.2' resulting in a side yard setback of 1.8' and to increase hardcover <br />in the 75-250' setback area to 3,637 s.f (34.3%) where 3,420 s.f (32.26%) exists and 2,680 <br />s.f (25%) is allowed. <br />WHEREAS, the applicant has applied to the City for an amendment to a <br />previously granted variance to pennit a change to the roof line. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota; <br />FINDINGS <br />1. This application was reviewed as an amendment to Zoning File #2227. <br />2.The property is located in the LR-IC Single Family Lakeshore Residential <br />Zoning District where one-half acre in area is required.
