Based on the presence of an existing driveway easement along the edge of the property, and the <br />location of the utility easement in this driveway area; the City's position is that the proposed utility <br />easement will result in minimal impacts to your property and is prepared to offer $1.00 per sf. for <br />the additional 4,800 sf. utility easement area. The $1.00 per sf. is our standard unit price for utility <br />easements. This results in a $4,800 payment for the easement. The installation of sewer will also <br />greatly benefit your property, as it will allow for future development of the property. <br />The City will also need to obtain an additional 10' wide temporary construction easement on each <br />side of the permanent easement to allow for installation of the sewer. This is a temporary easement <br />that expires after sewer installation is completed, so no term encumbrances are created on the <br />property. The City's position is that this temporary construction easement has no permanent effects <br />on the property therefore it has very minimal value. We are prepared to offer a $500 payment for this <br />easement. <br />Please review th..« <‘osement information and provide us with a response at your earliest possible <br />convenience. With the cooperation of property owners obtaining an easement can be a qujck and <br />easy process. Absent agreement from the property owners, obtaining easements can be a long <br />process. In order to avoid possible delays for this project, the City needs to conduct the easement <br />acquisition process concurrently with the assessment process. The owner of Lot 30 is having septic <br />system problems and needs to have sewer installation completed this year. <br />The city would like to have your response on this easement issue by Monday, April 5th. Absent a <br />positive response, that you are willing to provide the necessary easements to complete a sewer <br />project, the City Council will take action at ^eir April 12th meeting to initiate the Eminent Domain <br />Process for easement acquisition. This process allows the City to acquire an easement within <br />approximately 90 days. During this time period, the City and property owner can attempt to reach <br />an agreement on the value of the easement. If a satisfactory agreement between the City and property <br />owner caimot be reached, during this time period, the next step is to proceed with the condemnation <br />commission process. <br />Please contact me at 612-249-4621 should you have any questions regarding this project.
