372 Westlake Street <br />This property had been used as a single homestead with two rental cabins for many years. Currently, <br />the residence and cabins are vacant, and all are scheduled to be removed should a lot line <br />rearrangement be approved. <br />The property was assessed for one sewer unit, but has not yet been connected. A SAC fee is required <br />prior to connection. A non-conforming septic system is located within the 75' lakeshore setback. <br />This system was required to be vacated and the property connected to sanitary sewer in 1996. Staff <br />would recommend this occur for the newly proposed building site. <br />This lot is 2.01 acres, meeting the minimum lot size required by the zoning code. <br />364 Westlake Street <br />The lot is 0.6S acres and has a lot width at the street of 50'. A house and detached garage are located <br />on the property. It is currently being used as a rental unit, and is served with sanitary sewer. Mr. <br />Erickson intends to use the property as a rental unit until the property is sold. The Planning <br />Commission recommended the house be removed by January, 2000. Typically, lot line <br />rearrangements occur on properties that have existing residences that will not be removed. If this <br />rearrangement was approved without removal of houses (not requiring variances for new <br />construction) the house would remain as a legal non-conforming structure. The placement of the <br />house would not require new variances due to its existing location. <br />PROPOSED LOTS <br />The new lot line would be located on the existing house on the 372 Westlake Street lot. The cabins <br />in the 75' lakeshore setback would be located fully or partially over the lot line onto the 364 lot. <br />Prior to filing the subdivision all structures on the existing 372 property shall be removed, and the <br />septic system vacated. <br />Removal of the two cabins would reduce the "dwelling units" existing on the lot. Section 10.03, <br />Subdivision 7 allows only one dwelling unit per lot. Including the house the property contains 3 <br />"dwelling units".
