Request for Council Action continued <br />Page 3 <br />February 18, 1999 <br />Saga Hill Park Access <br />4.If an access drive was constructed on the Garden Lane right-of-way, a portion of the <br />land purchased through the DNR Natural and Scenic Grant Program would need to <br />be used either to gain access to the park parcel to the west or to provide a parking lot <br />to serve both the Natural and Scenic Area property and the park land to the west. <br />There is a covenant on the Natural and Scenic Area property that restricts the uses <br />allowed on the property. It is not clear whether the restrictive covenant would allow <br />a parking lot or an access drive that would ser\'e park uses beyond the Natural and <br />Scenic Area property. <br />Fairview Covenant Church Response to City's Letter <br />Staff was contacted by Dennis Poole, Fairview Covenant Church Pastor, on Thursday, February 18 <br />in response to the City's letter regarding access options. Pastor Poole indicated he had not checked <br />his mail at the Church until Wednesday, Februaiy' 17, which was the date by which the City had <br />requested a response from the Church. Pastor Poole indicated the Church could not respond <br />regarding the access options until after a congregational meeting was held, which could not occur <br />for at least three weeks. He indicated it was his understanding at the conclusion of the most recent <br />meeting with City representatives, that any access using the Church property would not be <br />"permanent" access, and as circumstances change for either the Church or the City an alternative <br />access may need to be provided. Pastor Poole will be in attendance at the February 22 Council <br />meeting. <br />COUNCIL ACTION REQUESTED: <br />Motion to direct staff regarding the provision of an access to the Saga Hill Park area. <br />t
