dependent day care reimbursement coverage under paragraph 5.2.3 or <br />(B), in the case of medicai reimbursement coverage under paragraph <br />5.2.2, if the Employee continues coverage in a manner consistent with this <br />Plan, and (iii) with respect to medicai reimbursement coverage under <br />paragraph 5.2.2, the Period of Coverage shall not include any portion of <br />the Plan Year for which the Participant does not pay the applicable Health <br />Care Reimbursement Charge. <br />(I) "Plan " means the "City of Orono Flexible Compensation <br />Plan" as set forth herein and as amended or restated from time to time. <br />(m) "Plan Year ” means the twelve-month period ending each <br />December 31. <br />(n) "Qualifying Individual " means a “qualifying individual" as <br />defined in Section 21(b) of the Code, which includes, on the Effective <br />Date of this Plan, (i) a Dependent of a Participant who is under the age of <br />thirteen (13), with respect to whom the Participant is entitled to an <br />exemption under Section 151(c) of the Code, and (ii) a Participant's <br />Dependent or spouse who is physically or mentally incapable of caring for <br />himself. <br />(o) "Status Change " with respect to a Participant means a <br />change in the Participant ’s marital status or number of Dependents, a <br />commencement or termination of employment of a Participant ’s spouse, a <br />change in the employment status of the Participant or the Participant ’s <br />spouse from full-time to part-time or vice versa, an unpaid leave of <br />absence of the Participant or the Participant ’s spouse, a family or medical <br />leave as described in Section 3.5, a significant change in the health <br />coverage of the Participant or the Participant ’s spouse that is beyond the <br />control of the Participant or the Participant ’s spouse and is related to the <br />employment of Participant ’s spouse, or such other changes In <br />circumstances that the Employer administratively defines as Status <br />L
