You offered some options for making possible the Service 800 access across from <br />Brimhall Avenue. This letter is to confirm our understanding of those options. <br />First, we understand that MnDOT will approve a right-in, right-out access at the existing curb-cut <br />at approximately the center of the Service 800 property ’s southerly Highway 12 frontage, on a <br />permanent basis, per your letter of January 8, 1999. That permit would be subject to a fee for <br />signage and striping of a westbound right-tum lane. <br />The options for access located directly across from Brimhall include the following: <br />1.MnDOT will approve an access driveway/road across from Brimhall under the existing right- <br />of-way configuration as long as the driveway/road extends to the MNDOT right-of-way <br />boundary at an angle of no less than 60 degrees from the shoulder of Highway 12. <br />The proposal for which a permit was recently requested by Service 800, extends to <br />the right-of-way boundary at an angle less than 60 degrees and which you consider <br />as functionally parallel to Highway 12, hence your denial of the permit. <br />Any design for an access directly across from Brimhall which meets the 60-degree <br />standard will likely extend to the Otten property rather than to the Service 800 <br />property, requiring an easement from Otten for Service 800 to use such access. <br />Under this option, Otten’s existing access into Lot 2, East Willow Woods, would <br />have to be eliminated. <br />Telephone (613) 473-7357 « FAX 4734)510
