3.Would the Planning Commission recommend the application be approved if the application <br />involved no situations that require after-the-fact approvals? The Comprehensive Plan and <br />Code address the issue of shoreland protection and do not allow extensive land alteration or <br />hardcover within the 0-75 ’ lakeshore setback. Please refer to Exhibits G and H (CMP 3-20 <br />and CMP 4-13) policies within the Comprehensive Plan stating the position of the City of <br />Orono as it relates to shoreland land alteration. <br />STAFF RECOMMENDATION <br />Staff recommends the application for a conditional use permit be denied based on the adverse <br />impacts of hardcover within the shoreland area. A second alterative is for a tabling of the <br />application to allow additional time for any enforcement action, although it is important to <br />send direction to the property owner the need for additional after-the-fact applications for the <br />land alteration that has occured and has been depicted on the latest survey. <br />540 Bradley A.
