Summary of Request: <br />The City of Orono has leceived a Preliminary Plat application for a seven lot residential development <br />for property located at 120 Brown Road South. The request would require the following approvals: <br />1. <br />2. <br />3. <br />4. <br />A Conditional Use Permit for a Planned Residential Development - This would allow the <br />property to develop at a two acre densiw using cluster development and preservation space. <br />Road width variance and a variance to allow the road to be developed at less than the <br />minimum requirements. Tract G is planed 40' in width where the City requires a minimum <br />planed width for a private residential road to be 50'. Although the plat indicates a 28' paved <br />width the applicant has proposed a 24' width road. The Subdivision Code requires a <br />minimum paved width for property serving 7 or mere sites to develop the road at a 28' width. <br />The subdivision will require a road crossing of a City Protected Wetland and locating a <br />NURP pond within 26' of the City protected wetland. The City Council and the MCWD <br />shall approve any wetland alteration on site. <br />The property is located outside of the Metropolitan Urban Services Area (MUSA). A MUSA <br />amendment shall be approved by the Cit>- Council and the Met Council to provide sewer to <br />the site. <br />5.The DNR has expressed concerns w ith the proposed sewer extension to the south end of the <br />project, with the intent of the developer and City to extend sewer under the Luce Line Trail. <br />Mr. Van Eeckhout would install sewer to the south boundarv' to provide service for the Fox <br />Ridge Sewer Project area. Fox Ridge and Mr. Van Eeckhout's property are divided by the <br />Trail. <br />The DNR has stated it is opposed to the line under the trail. Long term maintenance appears <br />to be the main issue. <br />6. <br />7. <br />A small portion of the Tract G is platted to the center of Brown Road. Hennepin County has <br />indicated it would require the west 33' be dedicated to the County for right-of-way. <br />Tract G is owned by Mr. John Dunn. Mr. Dunn is not a co-applicant. He would be required <br />to sign the plat documents and dedicate easements over the lot in favor of the City of Orono. <br />The easements would be necessary for public utility and drainage purposes.
