The <br />applicant should also be asked for his testimony regarding this issue. <br />Accessory Building (Stable) <br />The building to remain on the property has been located on the site for a long period of time. It is <br />a non-conforming structure as a result of the location of the building within the required side yard <br />setback. Relocation of the stable to the rear of the property will place it within the building <br />envelope. It also moves the structure away from Little Orchard Way to the rear of the property where <br />an accessory building normally is constructed. <br />Code requires principal buildings be located closer to the front lot line than accessory buildings. <br />Relocating the stable to the rear of the property al low's the lot to open for construction of a residence. <br />The stable is located only 62' from the front lot line. ^ variance would be required to construct a <br />house behind the accessory building because accessory buildings can not be located closer to the <br />front lot line than the principal building (Section 10.03, Subdivision 9 (D). <br />Dan Andersen <br />2835 Little Orchard Way <br />Variance <br />3/17/99 <br />Page!
