TO:Chair Smith and Orono Planning Commissioners <br />Ron Moorse, City Administrator <br />FROM: Paul Weinberger, Assistant Zoning Administrator <br />DATE:April 5,1999 <br />SUBJECT: #2468 Bruce and Betsy Nusbaum <br />3480 North Shore Drive <br />Variances—Public Hearing <br />Zoning District: LR-1C One Family Lakeshore Residential District (1/2 Acre) <br />Lot Area:9,560 square feet (.22 acre) <br />Application: Last month the Planning Commission voted to table this application to allow <br />the Nusbaums an opportunity to reduce the proposed structural coverage, not to exceed the what <br />currently exists on the property. The applicants have demonstrated in the revised site plan they have <br />reduced the structural coverage as recommended by the Planning Commission. <br />The applicants have proposed to remove the existing residence located on the lot and construct a two <br />story house. The existing residence is a non-conforming structure as it is located on an undersized <br />lot and encroaches into the required side yard setback. The house is located on the lot line. The new <br />structure would be placed to meet all required setbacks. <br />The lot is located in the LR-IC zoning district where 1/2 acre is the minimum lot size required for <br />new eonsUuclion. The zoning district also requires 100’ lot width for new construction. The zoning <br />code does allow certain lots to be record lots if the following conditions are met: <br />In "R" Districts of One Acre or Less and With Public Sanitary Sewer. A lot of record <br />existing upon the effective date of this Zoning Chapter in any "R" District of the City of up to and <br />including one acre, which lot is serviced by public sanitary sewer and which does not meet the <br />requirements of this Zoning Chapter as to area or width only, may be utilized for single family <br />detached dwelling purposes without Council approval if the area measurements and width of that <br />lot are within eighty percent (80%) of the requirements of this Zoning Chapter.
