Crosby, Jr. <br />Faegre & Benson LLP <br />2200 Norwest Center <br />90 South Seventh Street <br />Minneapolis, MN 55402-3901 <br />TRANSMITTAL BY FACSIMILE <br />Re: Spring Hill Golf Club <br />Dear Tom: <br />To establish some finality regarding the Spring Hill Golf Club project, I’ve reviewed City files on <br />the various elements and have come up with the following summary of items remining to be <br />completed: <br />A.File #2209 (Original CUP Application) <br />1.The three original copies of the approval resolution(Resolution No. 3902) with all <br />required attachments (using the legal description from Sheet 1 of 8 of the plat <br />drawings, and using the original Trail Agreement which was approved by Council <br />on June 12,1997) were signed by the Club representative in 1997 and have now been <br />signed by the Mayor and the City Clerk. One of the three originals will be forwarded <br />to you or to the Club as you direct.. <br />2.The Developers Agreement was fully executed by all parties. It appears that all <br />conditions cf the Developers Agreement have been followed or met, with the <br />exception of Addendum Item #5 which requires the granting of certain easements as <br />part of the platting process (see File #2480 comments). <br />3.The initial Letter of Credit in the amount of $578,250 was reduced to $463,125 on <br />5-18-98, further reduced to $67,0$0 on 4-15-99, and per our records apparently <br />expired on October 31, 1999 absent any formal extension, although such was <br />requested in my letter of April 15, 1999.
