Permit should not be issued until the following conditions are met: <br />1 .A surety of $5,100 for wetland alteration must be received. <br />2.A declaration for preservation of the 35-foot and 1 6.5-foot wetland buffers must be <br />executed and recorded. <br />3.Rule J fees must be paid. <br />Background: <br />The applicant is requesting an after-the-fact permit for wetland fill to construct a driveway for <br />access to a single-femily home. The City of Orono, in 1977, aUowed a 50-foot wide corridor <br />through a wetland area for access to Mr. Johnson ’s property. The City took a conservation <br />easement over the remaining wetland area. Access to ^s site is only available through the <br />corridor. An on site inspection by the DNR found tha ‘ ♦he driveway impact is outside of the <br />DNR wetland and is therefore covered under WCA ru <br />RuleD <br />Wetland fill to build the driveway amounted to 4,290 square feet. The proposed mitigation for <br />this impact is 8,600 square feet of new wetland adjacent to. the.^xistisfjgjyetiand.
