The Callahans have stated the building had suffered damages during the May, <br />1998 storm that they have requested to repair by applying for a building permit. The building permit was <br />received on O' tober 23,2000. Due to the following observations the building permit was denied: <br />1. <br />2. <br />3. <br />4. <br />5. <br />Repair to the existing structure would require replacement of the entire building. The intent is to <br />save the concrete slab. A final determination regarding the structural integrity of the slab could <br />not be made until the structure is removed. <br />The entire roof and rafters have rotted and shingles are damaged or missing. <br />Based the existing condition of the building, the structure has extended beyond its useful life <br />and the rotting of the corner posts and entire roof would r*;quire full replacement absent any <br />damage that may have resulted from the storm. <br />The building is located approximately 2.5’ from the west property line. <br />The building is located approximately 12' from the existing shoreline of Lake Minnetonka. <br />6.The building is 12.5’ X 7.6* in area (95 s.f.). <br />The City of Orono had established an interim Building Permit Procedure for properties damaged during <br />the storms in the Spring of 1998. A copy of the memo establishing the interim permit procedures has been <br />attached. Structures with 75% or less damage were permitted to be replaced without meeting zoning <br />standards (setbacks, hardcover, etc.) But did require a building permit review. The gazebo building <br />owned by the Callahan’s would require, as has been proposed, the replacement of the entire structure <br />which is beyond the 75% damage that would have been permitted under the interim permit procedures.
