r-----* <br />. t <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.31, SUBDIVISION 8 (C) <br />FILE NO. 2627 <br />WHEREAS, Willmar L. Thorkelson and Maxine B. Thorkelson (hereinafter "the <br />applicants") are owners of the property located at 440 Big Island within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />Lot 1, Scriver’s Subdivision of Lot E Morse Island Park and Lot 6 and the <br />South Half of Lot 7, Morse Island Park Second Addition, Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for an after-the-fact variance <br />to Municipal Zoning Code Section 10.31 Subdivision 8 (C) to permit an accessory structure to <br />be located 23' from the platted street right-of-way where 30' is required. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />3. <br />4. <br />This application was reviewed as Zoning File #2627. <br />The property is located in the RS Recreational Seasonal Zoning District requiring <br />five acres in area. The property consists of 48,781 s.f. or 1.12 acres. <br />The applicants’ son constructed a 12' x 24' accessory building on the property <br />without obtaining the appropriate building permit and in a location not meeting <br />the required street setback. <br />The Orono Planning Commission reviewed this application on October 16, 2000 <br />and voted 3 to 3 on a motion to recommend denial of the request.
