February 23,2000 <br />TO: Mr. Mike Gaffron <br />FROM: Jim Zimmerman, Richard and Sue Gay, Dick and Marlys Ogle <br />SUBJECT: Resident and Non-Resident Boat Docks <br />E Rl <br />h, ■■ <br />We understand that one of the non-resident boat owners has asked the city to revisit the parking <br />situation along County Road 19. We also noticed that one of die non-resident dock properties is <br />now being surveyed, and we’re concerned about what may be planned for this property. <br />The docks along Country Road 19 were set up to be resident docks for homeowners of the <br />Pheasant Laum Development. They were obviously never intended to be sold off as independent <br />properties or rented out as rental property as is now the case. <br />What started out in 1985 as the sale of a couple of docks for normal recreational use has grown <br />to the point noiv where we have essentially a condominium marina in our small neighborhood. <br />It’s creating a number of problems now, and we have a veiy real fear about what could happen <br />in the future with these properties. <br />There is also the issue of conditional use permits vs. no permits. The dock properties break into <br />the following three categories: <br />■ Resident Docks with No Conditional Use Permits - Olson and Casey <br />• Non-Resident Docks with No Conditional Use Permits - Gunther and Ault <br />■ Non-Resident Docks with 198.S Conditional Use Permits - Huber, Miegel, Wittman, Cook <br />There are currently issues relative to all 3 of the above categories of docks. Rather than address <br />the issues one at a time in isolation, we feel it is important to look at the total issue of the docks <br />and look at both short and long term issues. <br />In the short term, we w*ant to work with the city to clearly understand exactly what the rights are <br />of the neighborhood and what the rights are of the non-resident dock owners. Longer term, <br />since these properties are completely non-conforming and do not fit within the intent and <br />objectives of the Zoning Code and Comprehensive Plan of the City, we would look to work with <br />the city to bring this area into compliance with the current Zoning Codes and requirements. <br />Detailed below is background and histoty on the dock area in question. In addition, there is a <br />summary’ of current concerns about the dock area and the expanded use of the docks beyond <br />what was in place in 1985 when the permits were granted.
