: M <br />V . rj <br />A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.22. SUBDIVISION 1(A), <br />SECTION 10.22, SUBDIVISION 1(B), AND <br />SECTION 10.56, SUBDIVISION 16(C)(6), <br />FILE NO. 2617 <br />WHEREAS, Douglas J. Olson and Barbara J. Bowers, (hereinafter "the applicants") <br />are the owners of the property located at 2601 West Lafayette Road within the City of Orono <br />(hereinafter "the City") and legally described as follows; <br />Tracts C and F, Registered Land Survey No. 131, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Code Section 10.22, Subdivision 1 (A) to allow a second story addition on the existing <br />residence where a portion of it lies within 75 ’ of the OHWL of Lake Minnetonka and Sectio.n 10.22, <br />Subdivision 1(B) and Section 10.56, Subdivision 16(C)(6) to allow the second story addition to <br />encroach 70' into the average lakeshore setback. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 18,2000, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. <br />2. <br />This application was reviewed as Zoning File #2617. <br />The property is located in the LR-IB, Single Family Lakeshore Residential Zoning <br />District. <br />3.The Orono Planning Commission reviewed this application on September 18,2000 <br />and recommended approval by a vote of 5 to 0. <br />Page 1 of 5
