The Planning Commission made the following findings of fact: <br />A. <br />B. <br />C. <br />D. <br />E. <br />The proposed new residence will meet the required side setbacks of 10' on a <br />lot that is 50 ’ in width, and will meet the required 75' lakeshore setback. <br />The proposed improvement will result in an increase of hardcover within the <br />75-250' setback area to 2,647 s.f. (46.93%). It is not feasible to construct a <br />1,500 s.f. residence/attached garage on this small lot without exceeding the <br />25% hardcover allowance. The hardcover has been minimized to the greatest <br />extent possible while still accommodating an attached garage. <br />The structural coverage will increase from 1,150 s.f (11.3%) to 1,500 s.f <br />(15%), meeting the structural coverage limits imposed by City Code. <br />The improvement as proposed will not have a detrimental impact on the <br />values of the surrounding residences. <br />Th'* oroposed grading within 5' of the side lot lines will have no negative <br />impa ts on adjacent properties. <br />The City Council finds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variance would not adversely affect traffic conditions, light, air, nor pose a fire <br />hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable hardship <br />or difficulty; is necessary to preserve a substantial property right of the applicants; <br />and would be in keeping with the spirit and intent of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments by <br />the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />Page 2 of 6
